Au Pair USA Creator Community Terms and Conditions

Welcome! These Terms and Conditions (“Terms”) govern your participation in the Au Pair USA Creator Community program (the “Creator Program”) operated by InterExchange, Inc. (“we,” “us,” or “our”). By applying to or participating in the Creator Program, you (“you” or “Creator”) agree to these Terms.

1. Eligibility

To participate, you must:

  • Be at least 18 years old (or the age of majority where you live).

  • Have an active, public account in good standing on the platform(s) listed in your acceptance notice (e.g., TikTok, Instagram).

  • Comply with the rules of those platforms at all times.

  • Meet any additional eligibility requirements we share with you in writing.

We may verify eligibility at any time and remove anyone who doesn’t meet these requirements.

2. How the Creator Program Works

As an Au Pair USA Creator, you may create and submit social media content (each, a “Submission”) related to topics, themes, or prompts we provide.

Submissions must:

  • Be your original work that you have the right to share.

  • Follow any creative briefs, guidelines, or hashtags we provide.

  • Not include third-party material (music, footage, logos, trademarks, or images of other people) unless you have the necessary rights.

  • Comply with all applicable laws and the rules of the platform where they’re posted.

We are under no obligation to use, share, or publish any Submission. We may accept, reject, edit, or request changes to any Submission at our sole discretion.

3. Incentives

Incentives are based on the number of your Submissions that we publish. A Submission is considered “Published” when it is posted to one of our official channels (or otherwise distributed by us in a public way).

This Creator Program is not a contest, sweepstakes, or game of chance. Incentives are earned as compenssation for services rendered, based on editorial decisions made by us. Creators do not compete against each other, and no element of chance is involved in earning an incentive.

The current incentive structure is:

  • $200 gift card for three (3) Published Submissions

  • $100 gift card for two (2) Published Submissions

  • $50 gift card for one (1) Published Submission

Important details:

  • Submissions that are not Published do not earn an incentive, even if they were accepted, edited, or held for future use.

  • We decide which Submissions to Publish, when to Publish them, and on which channels.

  • Incentives have no cash value unless stated and cannot be transferred or substituted, except by us.

  • Incentives will be delivered within [30] days of the Publication date, using the contact information you provide.

  • You are responsible for any taxes owed on incentives. We may issue tax forms (such as a U.S. Form 1099) if required by law.

4. Your Content and the Rights You Give Us

By submitting your Submissions, you grant us a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to use, copy, reproduce, edit, adapt, modify, translate, distribute, publicly display, and publicly perform your Submissions — in whole or in part — in any media now known or later developed, for any purpose related to our organization, including marketing and promotion.

You also agree we may use your name, username, handle, voice, likeness, and approved biographical details in connection with your Submissions, without further notice or payment.

This license continues even after your participation in the Creator Program ends.

5. Your Promises to Us

By submitting content, you confirm that:

  • You created the Submission yourself.

  • You have the right to grant the license in Section 4.

  • Your Submission does not infringe anyone’s copyright, trademark, privacy, publicity, or other rights.

  • Anyone clearly identifiable in your Submission has given you permission to use their name and likeness.

  • Your Submission is truthful, not misleading, and not defamatory.

6. Disclosure and Honesty

Because you are receiving an incentive, you must clearly disclose your relationship with us in your posts — for example, with #ad, #sponsored, or a similar tag, or by using the platform’s built-in paid partnership tools — in line with U.S. Federal Trade Commission (FTC) guidelines and any applicable local laws.

Your opinions should be your own and honestly held. Don’t make claims you can’t support.

7. Conduct Guidelines

Your Submissions and your conduct as a Creator must not include or promote:

  • Hate speech, harassment, threats, or discrimination of any kind.

  • Sexually explicit, violent, or otherwise harmful content.

  • Illegal activity or anything that endangers minors.

  • False or misleading information about us, our partners, or the Creator Program.

  • Confidential information about us, our staff, or other Creators.

  • Personally identifiable information related to your host family.

We may remove you from the Creator Program at any time if we believe you’ve violated these guidelines.

8. Independent Relationship

You are participating as an independent individual, not as our employee, agent, partner, or joint venturer. Nothing in these Terms creates an employment relationship. You are responsible for your own taxes, expenses, and equipment.

9. Personal Information

We collect and use the personal information you share with us (such as your name, contact details, and payment info) to run the Creator Program and deliver incentives, as described in our Privacy Policy at https://www.interexchange.org/privacy-policy/ . By participating, you agree to the practices described there.

10. Ending Your Participation

You may leave the Creator Program at any time by giving us written notice at mfanna@interexchange.org .

We may suspend or end your participation at any time, with or without notice, for any reason — including if you violate these Terms or if we end the Creator Program.

If your participation ends, you stop being eligible for new incentives, but the content license in Section 4 continues. Any unpaid incentives you’ve already earned for Published Submissions will be delivered as scheduled.

11. Disclaimers

The Creator Program is provided “as is.” To the fullest extent allowed by law, we make no warranties, express or implied, about the Creator Program, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t guarantee that the Creator Program will be uninterrupted, error-free, or that any specific outcome will result from your participation.

12. Limitation of Liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Creator Program or these Terms. Our total liability to you for any claim related to the Creator Program is limited to the greater of (a) the total value of incentives you earned in the 12 months before the claim, or (b) one hundred U.S. dollars ($100).

13. Your Responsibility for Claims

You agree to defend, indemnify, and hold us harmless from any claim, loss, or expense (including reasonable attorneys’ fees) caused by: (a) your Submissions; (b) your breach of these Terms; or (c) your violation of any law or third-party right.

14. Changes to the Creator Program or These Terms

We may change the Creator Program or these Terms at any time. If the changes are significant, we’ll let you know by email, Whatsapp, or through other channels we normally use to communicate with Creators. If you keep participating after the change, you’re agreeing to the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

Any dispute arising out of or related to these Terms or the Creator Program will be brought exclusively in the state or federal courts located in New York County, New York, and you agree to the personal jurisdiction of those courts.

16. Other Important Stuff

  • Entire Agreement: These Terms, together with any program rules or briefs we share with you, are the complete agreement between us about the Creator Program.

  • No Waiver: If we don’t enforce a part of these Terms, that doesn’t mean we’re giving up the right to do so later.

  • Severability: If any part of these Terms is found to be unenforceable, the rest will still apply.

  • Assignment: You can’t transfer your rights under these Terms. We can transfer ours to a successor or affiliate.

17. Your Acknowledgment

By applying to or participating in the Creator Program, you confirm that you’ve read these Terms, understand them, and agree to be bound by them.
